Kimkins Diet - Class Action Suit Settled

As you all know I did the Kimkins diet in Week 12 and lost 3 pounds, I noted I liked the diet .....there was a Class Action Suit filed and it recently settled.

Today, October 29, 2010, Judge Rick Brown of the Riverside County Superior Court entered a verdict for the plaintiffs in a certified national class action lawsuit. The court entered a verdict against Heidi Diaz the owner of the diet website Kimkins.com for fraud and false advertising. The court awarded the class members restitution in the amount of $1,824,210.39. The court also awarded an additional $500,000 in punitive damages as well as attorney fees. The court then issued a temporary restraining order to freeze all of the assets of Ms. Diaz.

Most notably, the court also imposed an injunction requiring Heidi Diaz to post on all of her websites that: (1) she lied about her weight loss; (2) she lied about her after diet pictures; (3) she lied about testimonials on her website; and (4) she lied about the photographs used with the testimonials to promote the Kimkins website.

An injunction was also issued to prevent Heidi Diaz from contracting, harassing or cyberbulling the plaintiffs and the witnesses. A formal judgment will be entered before November 19, 2010.

The original complaint was filed over three years ago on October 15, 2007. I want to thank everyone who supported the class action lawsuit. The Ducks were wonderful. I met a lot of great people and made a lot of new friends fighting for a good cause. Heidi Diaz lied on her website and made the fatal mistake of lying in the courtroom. You cannot trust Heidi Diaz. I anticipate more legal (illegal) maneuvering by Heidi Diaz to evade the judgment. We will be prepared and I will be relentless. Again, I thank all you.

I lost weight with Kimkins but I only did it for ONE WEEK.  After reading above and some other things I found regarding the Kimkins diet I have to wonder if any of the people that had tremendous losses were real people.

As with any diet - you need to check with your doctor.  You need to know if diet is healthy for you.  You have to act on warning signs your body is giving you in any diet.

As I have said before - I am doing a Different Diet each week.  I am doing each diet ONE WEEK ONLY.  My doctor knows what I am doing and I am in contact with him as I need to be. From my own personal experience with Kimkins - I lost weight and was happy with that.  I did not do long term (although again for myself) I probably could have done longer and of course because I did not do any longer than a week I do not know if my body would have responded differently.

Open Response on Kimkins and The Revolving Diet.....

I have had a few comments in regards to the Kimkins Diet I did in Week 12.  Asking me not to continue on it as it was unsafe and there were lawsuits pending.

Apparently there have been issues noted through the internet that Kimkins is not safe and it’s a fraud.

Why is Kimkins singled out?  Remember Nutri-System several years ago had several lawsuits against them for gallbladder/stone issues.

Most diets out there offer promises and a good portion do not deliver.  While researching the diets I have completed already and future diets,  I am not looking at whether it is good or bad,  – you can see by  looking over the diets I have done so far, I do not discriminate, it could be a legit diet or a FAD diet.   I am doing each diet for a short length of time. 

Everyone starts a  diet with the grandiose hope that this one is it.  This one diet is going to be the one to magically help me drop all the pounds that I have been carrying for months and/or years. For me doing the one diet that “IS IT” hasn’t worked that’s how I started on this quest/experience.

No one has tried doing a different diet weekly and wrote about it.  This is what I do.

My personal quest is to find out if revolving from one diet to another will provide results.  In making the choice of doing a different  diet weekly – I try to mix it up enough so that if I am not getting the right balance (too much veggies, too much fruit, too much protein, too much of ONE KIND of FOOD, etc….) – I can make up the lack of something in the next week. 

My body is going to tell me something isn’t right (either nauseous, bloated, constipated, losing hair, zits, etc)… And from that information I make a choice whether or not going from Dr. Siegel’s Cookie Diet to the Oatmeal Diet is the right choice for the following week.  It is up to me to know if my body is having negative reactions to something I am putting in it (or not putting in it).

It comes down to ……..Is it the fault of the dieter or the diet? 

Did you check with your doctor, show him/her the diet you are planning on doing?  All diets come with those warnings….how many of us actually print out the diet or take that diet book and sit down with our doctors to discuss health benefits or negatives?

Or are we waiting until something  gets too bad then consulting with our doctor?

My Summary of Kimkins (Day 83)

Would I do this diet again - YES! I was completely satisfied.  I ate for the most part everything I like. I got exercise in (the good weather helped) and it was easy to follow. 

I think if after the year is up and for whatever reason I do not hit my goal by then I would definitely consider Kimkins long term.

I did not have any ill effects from Kimkins based on MY EXPERIENCE, I would do it again.  As I have said throughout this blog EVERY BODY is different, we all do not respond the same.  I may try an ALL CARB diet and gain 10 pounds in a week and my best friend could do the

same diet and lose 6 pounds ….

For me it’s been trying the different diets, sticking to them for the week and providing an outline of what diet I do weekly along with what I experience daily (with a little extra) and giving my SUMMARY of my overall feelings about the diet at the end of the week.

If after what you read by my experience makes you think – Hey, I might like to try that diet…..Check with your doctor!!!  Then if he/she okay’s , don’t run out and buy a months worth of groceries to do diet for a month…..GO SLOW, try a week at a time (or even a couple of days) Again, what might work for me – might not work for you.

My doctor is aware of what I am doing.  He gave me his blessing and he is there when I have questions, etc….

Keep an open communication with your doctor & know your body – if something is not right…STOP!!!!

Day 83 ~ 4/12/10 Summary of the Week ~ Kimkins Diet

Down 3 pounds!!!  Kimkins works!

Lots of protein, flexible menu and easy to do!  What else could you ask for? 

Not only did I have my period for the majority of week - I lost weight.  That definitely says something about a diet!!!! 

There was alot of information on their website (too much for me to list in the outline) but it was an easy website to navigate.  They have forums for EVERYTHING!!  Recipe forums were a great reference when looking for something different or just for ideas. There are also forums that you can ask on-site type motivators for assistance.  Reading others success stories always motivates me more (that and pictures of thinner people wearing clothing that I would like to own).

Cost when I signed up about $60 and it was for full access and lifetime membership.  Now if you go to their home page it states you can choose from (3) memberships, but only (2) are are shown.  Either $39.95 for a 3 Month Membership or $79.95 for a Year Membership.  It is pricier than when I joined - but in my opinion once you sign up you will get all the tools you need to continue longer if you need to go beyond the 3 months on your own.  If you feel you need the additional guidance go for the yearly membership - your looking at $6.66 per month (cheaper than Weight Watchers and you don't have to leave your house for a meeting, so no extra cost for gas).

Day 82 ~ 4/11/10

Another GORGEOUS day!!  I got another 3 hours of exercise in doing yard work....my arms and backs of legs are killing  me!!

Diet went fair today.  No time for breakfast so bunch all into (2) meals......

Breakfast: 1/2 Cup grapefruit juice, 1 latte

Lunch: Chicken Cesar salad (grilled chicken, 2 cups romaine lettuce, 2 Tablespoon dressing), 1 slice white pizza

Dinner: 1 Slice Marguerita Pizza

I love this time of year.  It's so much easier to enjoy salads and lighter foods.  Yes, I had pizza - new brick oven place opened by our house and I have been wanting to try them out.  Hubby wanted Chinese and I really have to be in the mood to have Chinese and the new Pizza Place is right next door so I opted for that.

Tomorrow I start the Oatmeal diet.....See right sidebar for outline.

Day 81 ~ 4/10/10

Happy Saturday!  It was GORGEOUS outside today!!  Worked in the yard (had to get some exercise in) for over 3 hours!!

Todays Meals:

Breakfast: 1/2 cup grapefruit juice, 1 latte

Lunch: 4 Egg Whites, 2 sausage Patties

Snack:  10 Thin Mint Girl Scout Cookies

Dinner: 1/2 Pizza Skins (frozen food from grocery store), 1 bottle of regular Birch Beer

Lunch was about the only meal I got right today.  Too tired after working in yard to run out for salad and "lighter" fare. Went with what was in the house. Sometimes you have to settle, in my case unfortunately the stuff that is quick to put together is usually higher carb choices....the Girl Scout Cookies I actually had while waiting for the frozen Pizza Skins to cook - I was over hungry (usually te time when you make really bad choices)

Other than that I really enjoyed being outside and taking advantage of the day. I am sore though - looking forward to just relaxing and watching some TV.

Day 80 ~ 4/9/10

The week just got better...It's Finally FRIDAY.....YIIIIIPPPPPEEEEE!!!!!!

I have had a fairly good week so far.  Even with my period things seem to be going well.  I had my usual chocolate cravings and have abstained.

Todays Meals:

Breakfast: 4 Egg White, 2 Slices Bacon, 1/2 cup grapefruit juice

Lunch: 3 Cup Green Salad with tomato (no dressing), 4 oz grilled chicken, 1/2 cup applesauce 

Dinner: (Had carbs tonight)  1 Cup Smart Balance Spaghetti, 3 oz steak.

Broke down and had carbs tonight, the steak we had was fatty and I thought there wasn't going to be enough meat for dinner so I added a carb,not a choice on Kimkins, but considering I could of had worse - I feel ok with my choice.

Not sure if you got the chance to read cruise info (on last entry) but if you did and have never been on a cruise, it's definitely something to try at least once. 

It's that time of year when Spring pops it's head out and thoughts of Summer and vacations are first and foremost.  I love to travel.  Growing up we always did stuff.  Whether it be an outing to a summer fair, trip to the beach, picnic at the park, a summer afternoon at a Flea Market, trip to a museum or a movie in the afternoon.  Pull the map out of your state and spin around a couple fo times and put you finger on the map....wherever you land - go there - I am sure there is something interesting to see...(if you know it's dangerous...DO NOT GO THERE....pick somewhere else....BE SAFE!!!)

You don't need to go far to have a vacation.  It's sharing the time away with a friend, husband, kids or a relative. It's taking a break from the routine.  Heck taking a bubble bath with a glass of wine is a vacation sometimes!!!

Those wheels are turning - I can smell the burning where I am just writing this!!

Day 79 ~ 4/8/10

Kimkins going well.  Protein is keeping me content.  It's been warmer in the NE and drinking more water (which also helps keep me satisfied.

From what I have been reading about Atkins & South Beach - this is very similar to both and I will be doing both Atkins & South Beach in the coming weeks - so we will see how the differences work out.

The Boot Camp Diet portion of Kimkins actually has Atkins and Slimfast Shakes as an option for breakfast on some meals within the established meal plan guideline.

Todays Meals:

Breakfast:  2 oz diced ham, 3 Egg Whites 1/2 cup grapefruit juice

Lunch: 4 oz ham, 2 cups green salad, hard Boiled Egg, 1 Tablespoons low cal dressing

Dinner: 6 oz Chicken Braciole in tomato sauce, 1 cup mixed steamed veggies

Day 78 ~ 4/7/2010

Yesterday was a day that I should of just stayed in bed. I woke up tired , got my period (TMI) and then the clogged up feeling I had all last week was reversed..BIG TIME...all that was left for me to do was to wear a skirt/dress to work and put a run in my pantyhose -I did not tempt fate and anyway who in their right mind wears -or- should I say bothers with wearing panthose when they have to contend with the bloating and the extra work of dealing with a period (again TMI).

The diet (or lack of) yesterday consisted of....

Breakfast: Iced Coffee,

Lunch: 1 Cup Cottage Cheese

Dinner: 4 Egg Whites, 2 sausage patties.

I am still trying to get it together today.....it's like I am in slow motion.

Todays Meals:

Breakfast:  4 Scrambled Egg Whites, 1/2 Cup Grapefruit Juice

Lunch:  Chicken Caesar Salad (5 oz chicken breast, 2 cups greens, 2 Tablespoon low fat oil/vinegar dressing), 1/2 cup raw carrots

Dinner: Take-out Beef & Broccoli (approx 4 oz beef, 1-12 cup broccoli) , 1 low fat vanilla yogurt

Still not all myself but slowing getting there.  Making it an early night.

Day 77 ~ 4/6/10

Day 76 ~ 4/5/10

Kick off to Kimkins Diet.  It is ALL laid out.....meal plans I can just use or substitute.

If you haven't read the breakdown on the right side bar...this is the "minimal" basics:

Exercise - 30 Minutes

No Limit on Calories

15 Ounces of Protein

20 grams of Carbs

Todays Meals:

Breakfast: 2 oz diced lean ham, 3 Egg Whites, 1/2 cup grapefruit juice

Lunch: 5 oz chicken breasts, 2 cups green salad, vanilla low fat yogurt

Dinner: 5 oz jerk chicken, 1/2 cup broccoli & cauliflower, 1/2 cup raw carrots

Good Day...the increase in protein was a filler!! 

Exercised 45 minutes in yard doing yard work - cutting down branches & lugging them to back of yard.  I covered everything to a "t" fo the first day!!

Now I am hoping he 2 pounds I gained this past week I can drop fairly quickly.....and also have my lower intestine back to normal after the Chlorophyll fiasco......
